The owner of the online store TOOLCENTER.EE (hereinafter the Online Store) is OÜ Tööriistaykeskus, (registration code 12935902), located at Rannaküla tee 14, Vääna-Jõesuu, Harku parish.
Validity of the sales contract, product and price information
The terms and conditions of sale apply to the purchase of goods from the Online Store. The prices of products sold in the Online Store are indicated next to the products and the base prices of all products on the Online Store's homepage are calculated in euros. A fee for delivering the goods is added to the price. The delivery fee depends on the buyer's location and the method of delivery. The delivery fee is displayed to the buyer when placing an order. Information about the goods is provided in the Online Store directly next to the goods.
Placing an order
To order goods, you must add the desired products to the shopping cart. To place an order, you must fill in the required data fields and select the appropriate method of delivery of the products. Then, the amount of the fee is displayed on the screen, which can be paid via a bank link or using another payment solution. The contract shall enter into force upon receipt of the amount due to the Online Store's bank account.
If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be notified as soon as possible and the money paid (including the costs of delivering the goods) will be refunded immediately, but no later than within 14 days of sending the notification.
Delivery
The goods will be sent to the following countries: Estonia. The buyer chooses the shipping method according to his/her wishes from the following cooperation partners: Itella Smartpost, DPD, or Omniva. The shipping costs of the goods are borne by the buyer and the corresponding price information is displayed next to the shipping method. Shipments within Estonia generally reach the destination specified by the buyer within 3-7 working days from the entry into force of the sales contract. In exceptional cases, the buyer has the right to deliver the goods within 45 calendar days.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods may not be used in any way other than necessary to verify the nature, properties and functioning of the goods in the manner permitted for testing the goods in a physical store. If the goods have been used for any purpose other than necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Online Store has the right to reduce the return fee in accordance with the decrease in the value of the goods.
To return the goods, a withdrawal form must be submitted and sent to the e-mail address info@toolcenter.ee no later than 14 days after receipt of the goods.
The costs of returning the goods are borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to the order (e.g. a wrong or defective item). The buyer must return the goods within 14 days of submitting the application or provide proof that he or she has handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the Online Store shall refund to the Buyer immediately, but no later than 14 days after receipt of the withdrawal form, all fees received from the Buyer under the contract. The Online Store may refuse to make refunds until the item that is the subject of the contract has been returned or until the Buyer has provided evidence that the item has been returned, whichever is earlier.
If the Buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store shall not be required to refund the Consumer any costs that exceed the costs associated with the standard delivery method. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the Buyer if the price of the goods in the Online Store has been indicated significantly below the market price of the goods due to an error.
Right to file a claim
The Online Store is liable for any non-compliance or defect of the goods sold to the Buyer with the terms of the contract that already existed at the time of delivery of the goods and that becomes apparent within two years of the delivery of the goods to the Buyer.
During the first six months after the delivery of the item to the buyer, it is assumed that the defect already existed at the time of delivery. It is the responsibility of the Online Store to rebut this assumption. If a defect is discovered, the buyer has the right to contact the Online Store no later than two months later by sending an e-mail to info@toolcenter.ee or by calling +37256503755.
The Online Store is not responsible for defects that have arisen after the goods have been delivered to the buyer. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer. The Online Store will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The online store uses the personal data entered by the buyer (including name, telephone number, address, e-mail address, bank details) only to process the order and send the goods to the buyer.
The online store transfers personal data to companies providing transportation services in order to deliver the goods.
The online store sends newsletters and offers to the buyer to the buyer's e-mail address only if the buyer has expressed a desire to do so by entering their e-mail address on the website and has indicated their desire to receive direct mail notifications.
The buyer can opt out of offers and newsletters sent to the e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.
Dispute resolution
If the buyer has any complaints about the online store, they must be sent by e-mail to info@toolcenter.ee or by calling +37256503755.
If the buyer and the online store are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the online store. The examination of the buyer's complaint by the Commission is free of charge.
The buyer may turn to the European Union's consumer dispute resolution platform.
